Terms of Service

The plain-English version: you pay in advance and services renew automatically until you cancel; new shared hosting customers get a 30-day money-back guarantee; you are responsible for what is on your account and for keeping your own backups; and we can suspend accounts that are unpaid or that break the rules.

1. Agreement

These Terms of Service ("Terms") are an agreement between NexaraHost ("we", "us") and the person or business that orders services from us ("you"). By placing an order, creating an account, or using our services, you agree to these Terms, our Acceptable Use Policy, our Privacy Policy, and our Service Level Agreement. If you do not agree, do not use the services.

2. The services

We provide shared web hosting, email hosting, and related services such as domain registration, website migration, and website care plans. The features and limits of each plan are those shown on our website and in your order at the time you purchase.

We operate our services on infrastructure supplied by third-party data center and network providers. We choose and manage those providers, and we remain your point of contact and are responsible to you for the service.

3. Your account

  • You must be at least 18 years old and provide accurate, current contact and billing information.
  • You are responsible for everything done through your account and hosting logins, including by people you give access to. Keep your passwords secure and tell us promptly if you suspect unauthorized access.
  • We send service and billing notices to the email address on your account. Keeping that address current is your responsibility.

4. Billing, renewals, and late payment

  • Prepaid terms. Services are billed in advance for the term you select (for example, monthly or annually). Prices are in US dollars.
  • Automatic renewal. Services renew automatically at the end of each term at the then-current price. We issue a renewal invoice before the due date and, if you have a card on file, charge it on or around the due date. To avoid renewal, cancel before the due date.
  • Price changes. We may change prices for future terms. We will notify you by email at least 30 days before a change affects your renewal.
  • Late payment. If an invoice is more than 5 days overdue, we may suspend the service. If it is more than 30 days overdue, we may terminate the service and permanently delete its data, including websites, email, databases, and backups.
  • Chargebacks. Please contact us first if you dispute a charge. If you open a chargeback for a valid charge, we may suspend the service while it is resolved and recover any dispute fee our payment processor charges us.
  • Taxes. Prices exclude any sales or similar tax we are required to collect, which will be shown on your invoice.

5. 30-day money-back guarantee

If you are a new customer and are not satisfied with a shared hosting plan, ask for a refund within 30 days of your first purchase and we will refund the hosting fee for that plan to your original payment method.

The guarantee does not cover:

  • domain name registrations, transfers, and renewals;
  • SSL certificates purchased separately, and other third-party licenses or add-ons;
  • setup, migration, website care, or other labor-based service fees once the work has been performed;
  • VPS, dedicated, or custom-quoted services;
  • renewals, or second and later hosting accounts;
  • accounts suspended or terminated for violating these Terms or the Acceptable Use Policy, or that exceeded their plan's bandwidth limit during the 30 days.

Outside the guarantee, payments for a term that has started are non-refundable, except where the SLA provides a credit or the law requires otherwise.

6. Cancellation

You can cancel at any time from the client area or by emailing support@nexarahost.com from the address on your account. You may choose to cancel immediately or at the end of the current term. When a service ends, its data is deleted, so download anything you need first.

7. Acceptable use and resource limits

Your use of the services must follow the Acceptable Use Policy. Shared hosting is for running websites and their email. Each plan has disk space, bandwidth, website, and email account limits; if you regularly need more, we will ask you to upgrade. Where one account's usage harms other customers on the same server, we may temporarily limit or suspend it and will contact you to resolve the cause.

8. Your content

You keep ownership of everything you upload. You give us permission to store, copy, and transmit it only as needed to provide the services, including making backups. You are responsible for your content and for having the rights to use it, and for the actions of your own users and customers.

9. Backups

We take automated daily backups of hosting accounts as a courtesy and will help you restore from them where we can. Backups are not guaranteed to be complete or available for any particular date, and they are not a substitute for keeping your own copies. You are responsible for maintaining independent backups of anything you cannot afford to lose.

10. Domain names

Domain registrations are provided through an accredited third-party registrar and are subject to that registrar's terms and the policies of ICANN and the relevant registry. Registration fees are non-refundable once a domain has been registered, transferred, or renewed. You are responsible for renewing domains you want to keep; an expired domain may be lost or may incur redemption fees set by the registry.

11. Support

Support is provided by ticket and email. We aim to respond to every request within one business day and handle service-affecting problems first. Our systems are monitored around the clock. Support covers the hosting service itself: the server, control panel, email, DNS, and SSL. Building or debugging your website's code, themes, and plugins is outside standard support, though we will point you in the right direction where we can or quote for the work.

12. Suspension and termination by us

We may suspend or terminate a service, with notice where practical, if you breach these Terms or the Acceptable Use Policy, if payment is overdue, if your account is being used for fraud or is compromised, or if we are required to by law. Where the problem can be fixed, we will normally give you the chance to fix it. No refund is due for services terminated for breach. We may also discontinue a service for any reason on 30 days' notice, in which case we will refund any prepaid fees for the unused part of your term.

13. Indemnity

You agree to defend and indemnify NexaraHost and its suppliers against claims, losses, and costs (including reasonable legal fees) arising from your content, your use of the services, your breach of these Terms, or anything done through your account or logins.

14. Disclaimers and limitation of liability

The services are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the services will be uninterrupted or error-free; the SLA sets out your remedy for downtime.

To the fullest extent the law allows, we are not liable for lost profits, lost revenue, lost data, or any indirect, incidental, special, or consequential damages, and our total liability for any claim relating to the services is limited to the amount you paid us for the affected service in the three months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law.

15. Changes to these Terms

We may update these Terms from time to time. We will post the new version here with a new "last updated" date and, for changes that materially affect you, email you at least 14 days before they take effect. Continuing to use the services after the effective date means you accept the updated Terms.

16. General

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules, and the state and federal courts located in California have exclusive jurisdiction over disputes. If any part of these Terms is found unenforceable, the rest remains in effect. You may not assign this agreement without our written consent. These Terms, together with the policies linked above and your order, are the entire agreement between us about the services.
